POLICY, TERMS & CONDITIONS
RATE AND BILLING PROCESS
Payment is due in full upon receipt of invoice. Advertisers are billed at special contract rates based on frequency. Any advertiser who fails to fulfill the contract
will be billed for the difference of the actual rate earned. Frequently discounted advertisers will be billed separately for each issue at time of printing for that
respective issue.
RATE CHANGES
Horses Incorporated reserves the right to change rates at any time. Rate changes will not affect current contract holders.
CANCELLATIONS
Advertisers may not cancel insertion orders for an upcoming issue after the space reservation deadline. Cancellations before the space reservation deadline must
be submitted in writing to the publisher.
GUARANTEED POSITIONS
Horses Incorporated magazine will make every effort to place your ad where requested (excluding premium positions). However, Horses Incorporated reserves
the right to reposition your ad placement in the magazine due to production requirements. Placements are subject to the publisher’s approval. The advertiser
agrees to pay for the original advertisement rate in full whether or not Horses Incorporated complies with the positioning request. All such requests must be
contained with your insertions order.
GENERAL REGULATIONS
Advertisements are subject to acceptance by Horses Incorporated Magazine. The publisher reserves the right to refuse or cancel any advertising for any reason
at any time.
Advertisements that run in Horses Incorporated are subject to terms and conditions of the Horses Incorporated rate card included in this media kit. It is the
responsibility of the advertiser to acquire, read this card and abide by the regulations listed therein. Advertisers (by choosing to place advertising in Horses
Incorporated Magazine) specifically agree to the terms and conditions contained therein; for this purpose, copies of the rate card are available from the publisher
and may be obtained free of charge.
The publisher reserves the right to place the word “Advertisement” on ads that simulate the editorial format and design of Horses Incorporated Magazine or
which resemble editorial matter.
All advertising copy is subject to the publisher’s approval. All ads are accepted and published on the representation that the advertisers are authorized to publish
the entire contents and subject matter of their ads. In consideration of the publisher’s acceptance of such advertisements for publication, both advertisers and
their agencies will indemnify and save the publisher harmless from and against any loss or expense arising out of publication of such advertisements, including
but not without limitation to, those resulting from claims or suits for libel, violation of right of privacy, plagiarism and copyright infringement.
The publisher is not liable for any delays in delivery or for non-delivery in the event of an act of god, action by any government entity, fire, flood, insurrection,
riot, explosion, embargo (legal or illegal), strike, labor or material shortage, transportation interruption of any kind, work slowdown or any condition beyond the
control of the publisher affecting production or delivery in any manner.
The publisher and/or printer is not responsible for errors in the advertisers index nor for any other typesetting or service done by the publisher.
The publisher’s liability for any reason or error will not exceed the cost of the space actually paid for by the advertiser or agency.
In the event of nonpayment, the publisher reserves the right to hold the advertiser and/or the advertising agency jointly and severely liable for such monies as
are due and payable to the publisher. The advertiser or agency further agree that should the publisher be required to collect any sums not paid, the publisher
shall be entitled to collect all reasonable costs and fees associated with collection, including reasonable attorney fees.
No conditions printed or otherwise, appearing on insertion orders, contracts, insertion instructions or any other form of correspondence that conflict with these
policies will be binding for the publisher.
